Terms of Service

These Terms of Service (“Terms”) govern your use of the NutriChef web application and related services (the “Service”), operated by NutriChef AI ([ABN pending registration]). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and 18, you must have parental consent. You must provide accurate, current, and complete information when registering.

2. Accounts

You are responsible for safeguarding your account credentials and for all activity under your account. Notify us immediately at support@nutri-chef.org if you suspect unauthorised access.

3. Subscriptions + billing

Free-tier features are listed on our pricing page. Paid plans are billed in advance, in the currency shown at checkout, via Stripe.
Subscriptions auto-renew at the end of each billing period unless cancelled before renewal. You can cancel at any time from your account settings; cancellation takes effect at the end of the current period.
Statutory consumer guarantees under the Australian Consumer Law apply and are not excluded by these Terms. Outside those guarantees, fees already paid are non-refundable.

4. Acceptable use

You agree not to:

upload pantry images or any content that infringes another person’s rights;
attempt to reverse-engineer, scrape, or overload the Service;
use the Service to generate content for resale or to train competing AI models;
use the Service for any unlawful purpose.

5. AI-generated content + nutrition disclaimer

Recipes, meal plans, ingredient substitutions, allergen flags, and nutrition information in the Service are generated by AI (currently Google Gemini) and third-party recipe data (Spoonacular). They are for general guidance only and are not a substitute for professional dietary, medical, or allergy advice.

Allergen safety: while we apply a two-stage AI safety check to flag known allergens and derivatives, you must independently verify every ingredient and label before consuming any food, especially if you or a member of your household has a serious allergy or medical condition. We make no warranty that any plan or recipe is free of any specific allergen.

6. Intellectual property

The Service, including its design, code, branding, and curated content, is owned by NutriChef AIand licensed to you for personal, non-commercial use during your subscription. You retain ownership of content you upload (e.g. pantry photos), and you grant us a non-exclusive, worldwide, royalty-free licence to process that content solely for the purpose of providing the Service to you, with the right to sublicense to our service providers (listed in our Privacy Policy) solely as needed to operate the Service.

7. Third-party services

The Service relies on third-party providers (see our Privacy Policy for the full list). We are not responsible for outages, errors, or content originating with those providers, beyond what is required by law.

8. Termination

You may terminate your account at any time from your settings. We may suspend or terminate your access for material breach of these Terms (such as the acceptable-use rules in §4), non-payment, or to comply with the law. We will give reasonable notice where practicable.

9. Limitation of liability

To the maximum extent permitted by law (and without limiting the consumer guarantees in the Australian Consumer Law): the Service is provided on an “as is” basis; we exclude all implied warranties; and our aggregate liability for any claim arising out of or in connection with the Service is limited to the fees you have paid us in the 12 months immediately preceding the claim.

10. Indemnity

You agree to indemnify NutriChef AI against any claim arising from (a) your breach of these Terms, (b) your misuse of the Service, or (c) content you upload that infringes a third party’s rights.

11. Changes to the Service or these Terms

We may modify the Service or these Terms from time to time. Material changes to these Terms will be notified by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

12. Governing law

These Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales, Australia have non-exclusive jurisdiction over any dispute.
